Terms of Service
- These terms cover NativeServer, the optional online service used by NativeServer builds of NativeGrind.
- The standard app doesn't use NativeServer and is covered only by the NativeGrind Licence.
- You must be 18 or over.
- NativeGrind isn't Grindr and isn't endorsed by Grindr. Using it may break Grindr's terms and could get your Grindr account banned.
- Don't use NativeServer to track, identify, harass or expose anyone.
- Some of what NativeServer stores is public. Read the Privacy Policy to see exactly what.
This summary isn't a substitute for the full terms below.
1. Who we are
NativeGrind and NativeServer are run by Jay Brammeld ("we", "us"), an individual based in Scotland. You can contact us at jay@imaoreo.dev.
2. What these terms cover
These terms apply when you use NativeServer: the online service that NativeServer builds of the NativeGrind app connect to for accounts, syncing between your devices, and media backups (together, the "Service").
The NativeGrind software itself, including the standard build that never connects to NativeServer, is licensed under the NativeGrind Personal Use Licence. If you only use the standard build, these terms don't apply to you. If you use the Service, both the Licence and these terms apply, and where they conflict about the Service, these terms take priority.
3. Accepting these terms
You must accept these terms and the Privacy Policy in the app before using the Service. If you don't agree, don't use the Service. You can keep using the standard build instead.
4. Who can use the Service
- You must be at least 18 years old.
- You must be legally able to agree to these terms where you live.
- You must not use the Service if we have previously removed your access.
5. Not affiliated with Grindr
NativeGrind is an independent project. It is not affiliated with, endorsed by, sponsored by or connected to Grindr LLC or its group companies. "Grindr" is a trademark of its owner and is used here only to describe what NativeGrind works with.
Using a third-party client may breach Grindr's own terms. Grindr may restrict, suspend or ban accounts that use one. You use NativeGrind and the Service at your own risk, and we aren't responsible for any action Grindr takes against your account.
6. Your NativeServer account
- Your account is tied to your devices using keys created on each device. Keep your devices secure. Anyone with access to a linked device can use your account.
- You can link and remove devices, and delete your account, from the app's NS Account settings.
- You're responsible for what happens through your account.
7. What the Service does with your data
The Privacy Policy explains this in full. In short: data you sync between your own devices (such as chats and account details) is encrypted on your device before it's sent, so we can't read it. Some other data, including profiles, profile photos and backed-up chat and album media, is stored in a form that is publicly accessible to anyone who knows its identifier.
8. Acceptable use
You must not use the Service, or any data you get from it, to:
- track, locate, follow, stalk or monitor any person;
- identify, "out", expose or reveal anyone's sexuality, identity, location or other personal details;
- harass, threaten, blackmail, intimidate or discriminate against anyone;
- share intimate images or anyone's personal data without their consent;
- build databases, profiles or dossiers about people, or sell or pass data on to others;
- break any law, including data protection law, or help anyone else do so;
- bypass or attack the Service's security, rate limits or authentication, or overload or disrupt it (see also the Licence and Developer Authorization Policy);
- upload anything unlawful, including any sexual content involving anyone under 18.
We may report illegal content or activity to the appropriate authorities.
9. Content you upload
When the app backs up media to the Service, you confirm you're allowed to do so. You keep whatever rights you have in it, and you give us a licence to store, copy and serve it only as needed to run the Service as the Privacy Policy describes. We may remove any content at any time, including content reported to us.
10. Reporting content and requests to remove data
If you believe the Service holds content or data about you, or content that shouldn't be there, contact jay@imaoreo.dev. This applies whether or not you use NativeGrind. The Privacy Policy explains your rights.
11. Availability and changes to the Service
The Service is a personal project provided free of charge. It may change, have downtime, lose data or stop entirely, at any time and without notice. Don't rely on it as your only copy of anything important.
12. Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or end your access, or delete your account, at any time, including if you break these terms or the Licence or if we need to protect the Service, other people or ourselves. Sections 5, 13, 14 and 16 continue to apply after your access ends.
13. No warranty
The Service is provided "as is" and "as available", without any warranty, to the fullest extent the law allows. We don't promise it will be accurate, secure, uninterrupted or free from errors.
14. Our liability
To the fullest extent the law allows, we aren't liable for any loss or damage arising from your use of, or inability to use, the Service, including loss of data, loss of access to any third-party account, or any action a third party takes against you. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud.
15. Changes to these terms
We may update these terms. When we make a change you need to agree to, the app will ask you to accept the new version before you can keep using the Service. The version and date are shown at the top of this page.
16. Governing law
These terms are governed by the law of Scotland, and the Scottish courts have exclusive jurisdiction, unless the law where you live gives you the right to bring a claim in your local courts.
